Retail sales jobs hit by new sexual harassment laws

Employers in the retail sales are likely to be among the hardest hit by new sexual harassment rules, an industry expert has claimed.

However, bosses in business to business (B2B) sectors, such as Business Services sales, will also be affected.

Amendments to rules that come into force in April require employers to protect employees from sexual harassment from third parties following more than two reported instances.

However, employment partner at MWR Solicitors, Sadiq Vohra, warns that firms such as those with sales jobs employees in the retail sector will have difficulties "exerting their authority over a customer or supplier".

Companies can do their best to ensure that their own employees respect sexual harassment rules by conducting sales recruitment through a sales recruitment agency.

But Mr Vohra added that it was also important to protect employees when the claim concerns a client, "especially a large customer".

"Failure to protect their employee from this type of sexual harassment, could result in a claim against them for uncapped and extensive compensation," he said.
